Privacy policy

What happens with your data?

Uploaded images

We have designed Smartmockups with privacy in mind. We don’t collect your uploaded images and it is never uploaded to the internet. Smartmockups only downloads the required data and the final mockup is created on your device. Your uploaded image is never uploaded to the Internet.

We don’t share this data with any third parties. But if you use our “sharing” feature, your final mockup has to be uploaded to our servers but we automatically remove these images after 60 days.

Personal data

We only ask for the minimum amount of data we need to create your account. We only collect your email address and, if you choose to disclose it, your name and billing address. We also keep your password in an encrypted form.

Third-party services

Smartmockups wouldn't be possible without relying on third-party services.

Servers, cloud, user management

Smartmockups runs on Amazon web services (AWS). Various services are used in combination (including but not limited to Lambda, Cognito for secure user management, SES, and S3). We use a service called Imgix to distribute images around the world and our static pages are hosted on Netlify.

Payment processing

Our order processing is conducted by online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handle returns.

User support

If you send us an email to hello@smartmockups.com, we will use HelpScout to reply to you. Additionally the little chat bubble on the right is from SmallChat and it sends us your messages directly on to Slack, where we can answer.

Newsletters and transactional emails

We use Braze to inform you about new features or mockups. Also when you create an account, we will send you a couple of automated emails to help you get started. This process is also undertaken by Braze.

Usage statistics, tracking & marketing

We make use of Google Analytics and Amplitude. We might also advertise on Facebook or Google Adwords.

This privacy policy ("Privacy Policy“) explains how we collect, use and disclose your personal data and how you can exercise your privacy rights. We will respect your right to privacy and treat your personal data in accordance with all applicable laws. If you have any questions, suggestions or complaints about our use of your data or this Privacy Policy, please contact us using the details provided below.

Information you provide to us

If you choose to create an account, we will collect certain information from you. We only ask for your email address and password. We may also (if applicable) collect your billing address for invoicing purposes. If you contact us, for example to report a problem or send us a question, we store details of the communication. Finally, if you upload any images or videos to Smartmockups, we will also process any personal data contained in your images and videos. We only use your images and videos to provide the functionality of the service to you.

We use your information to provide you with our services, create and maintain your account, respond to your questions and comments, issue invoices to you (if applicable), provide you with news and updates on Smartmockups, and improve our services for you and other users.

Statistics using Google Analytics

Our website uses Google Analytics, a web analytics service provided by Google, Inc. ("Google“). Google Analytics uses “cookies” (see below) to help the website analyse how users use the site. The information generated by the cookie about your use of the website will be transmitted to and stored by Google on servers in the United States. Where IP-anonymisation is activated on this website, your IP address will be truncated. Google will use this information on behalf of the operator of this website for the purpose of evaluating your use of the website, compiling reports on website activity and providing them other services to us relating to website activity and internet usage. Your IP address will not be associated with any other data held by Google. You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of this website. You can also opt-out from being tracked by Google Analytics by downloading and installing Google Analytics Opt-out Browser Add-on for your current browser available here: https://tools.google.com/dlpage/gaoptout.

Remarketing & tracking

Our website also uses Google AdWords and other remarketing/tracking services such as Facebook to advertise on third party websites. This could be in the form of an advertisement on the Google search results page or a site in the Google Display Network, for example. Third-party vendors, including Google, use cookies to serve ads based on someone's past visits to our website. Any data collected will be used in accordance with our privacy policy and Google's privacy policy. Cookies

Smartmockups makes use of cookies. When you visit our website, Smartmockups servers send a cookie to your computer. Smartmockups may uses session-based and persistent-based cookies. Session cookies persist during a browser session but disappear when you close or quit the browser. They allow us to identify you and to process your online transactions and requests. Persistent cookies remain after you close or quit the browser. Smartmockups uses persistent cookies to ensure effective operation of the services and for analytics purposes. We may collect certain information through cookies, such as your IP address and other information about your computer or device, and we may link or combine this information with other personal data we process about you. We do this for purposes such as providing our services, for fraud, security and authentication purposes, and to improve our services for all users.

You can choose to disable cookies on your browser but some functionality of the services may be affected. You will be able to navigate our website but may not be able to successfully use the services. IP addresses

Smartmockups collects your internet protocol ("IP“) addresses to track usage of our website and collect aggregate statistics for analytics and security reasons. For example, Smartmockups uses IP addresses to guess a currency based on your location.

Legal basis for processing your data

We need a legal basis to collect, use and disclose your personal data. Our legal basis will depend on the data concerned and the context in which it is processed. However, we will normally process your data only where we need the data to perform a contract with you (for example, to create and maintain your account, to respond, it is in our legitimate interests to do so (for example, to ensure system security, for advertising purposes and improve our services for all users), or we have your consent to do so. In some cases, we may also have a legal obligation to process your data (for example, to comply with applicable legal, tax or accounting requirements or respond to legal demands).

Sharing your personal data:

We may disclose your personal data to the following categories of recipients:

  • to our group companies, services providers and partners who provide data processing services to us (for example, to host our services, provide functionality, or help enhance the security of our website) or who otherwise process data for purposes that are described in this Privacy Policy or notified to you when we collect your data.
  • to any competent law enforcement body, regulatory, government agency, court or other third party where we believe disclosure is necessary as a matter of applicable law or regulation, to exercise, establish or defend our legal rights, or to protect your vital interests or those of any other person.
  • to an actual or potential buyer (and its agents and advisers) in connection with any actual or proposed purchase, merger or acquisition of any part of our business, provided that we inform the buyer it must use your personal information only for the purposes disclosed in this privacy policy.
  • to any other person with your consent to the disclosure.

Data storage and transfers

Your data is hosted on AWS servers in [the United States]. Your data may also be transferred to other countries where our affiliates or vendors maintain facilities. This means that your data may be transferred to and processed in countries that have data protection laws different to the laws of your country (and which, in some cases, may not be as protective). However, we've taken appropriate safeguards to ensure that your data remains protected in accordance with this Privacy Policy and applicable data protection laws, for example implementing standard contractual clauses with our affiliates and vendors.

Data retention

We only retain your personal data so lond as we have an ongoing legitimate business need to do so (for example, to provide you with a service or to comply with applicable legal, tax or accounting requirements). When we have no ongoing legitimate business need to process your data, we will either delete or anonymise it or, if this is not possible (for example, because your data has been stored in backup archives) then we will securely store your personal data and isolate it until deletion is possible.

Your rights

You have certain rights under applicable data protection laws. You have the right to ask us about the personal data we process about you and access your data. You have the right to get incorrect personal data corrected, ask for your data to be deleted and (in certain cases) restrict the processing of your data. If we process your data on the basis of your consent, you can revokeyour consent at any time. Similarly, if we process your data on the basis of our legitimate interests you can object to our processing of your data. Changes to this policy

We may update this Privacy Policy from time to time to reflect our current practice and ensure compliance with applicable laws. When we post changes, we will revise the “Last Updated” date above. We recommend that you check this page from time to time to inform yourself of any changes.
